MAKING A BOOKING

You must be 18 years of age or over to book accommodation and stay at any of the properties of Costa del Sol Home with a View, hereafter referred to as CDSHWAV.

The minimum number of nights that can be reserved with us is two. Sorry we cannot accept one night reservations.

The maximum number of guests in the accommodation is mentioned on each of the property pages and cannot be increased for safety and insurance reasons.

All bookings should be treated as provisional until you receive confirmation from us via email. To secure your booking a non-refundable deposit of 20% (or full payment) of the cost of your stay is required. Bookings must be paid in full 8 weeks before your arrival date. If your booking is less than 8 weeks from the date of your stay the full cost of your stay is required.

When you submit a booking and payment you will be requested to read and accept these terms and conditions of booking. You will receive an automatically generated booking confirmation and payment summary by email to the email address you provided at the time of booking. This booking confirmation email forms a contract between you and CDSHWAV.

If the balance is not paid by the due date, CDSHWAV reserves the right to re-let your accommodation and retain the deposit.

The prices featured on the website are not binding. We reserve the right to modify these prices at any time. The price stated on your booking confirmation email is binding.

CDSHWAV reserves the right, at all times, without statement of reasons, to refuse or cancel a booking. In the case of a cancellation by CDSHWAV, any moneys paid to us will be refunded.

 

DAMAGE DEPOSIT

A 200 eur refundable damage deposit must be paid when you book with us for the first time. This must be paid a week before your arrival date and will be refunded within a week after your departure, provided that the apartment is left in good condition.

 

ARRIVAL & DEPARTURE TIMES

Your accommodation will be ready by 17:00 on the day of arrival and must be vacated by 10am on the day of departure.

If there is no check-out on the same day, we may agree to an earlier check-in. Also, if there is no check-in, we may agree to a later check-out. We will confirm by email if this is possible.

Check-ins later than 23:59 at Esmeralda studio will incur a 20 eur charge.

 

CANCELLATIONS

Any cancellation must be in writing via email and will only be effective once we send written confirmation of the cancellation to you. Please see REFUNDS section for your entitlement to refunds. Cancellations made within 7 working days of your stay date, will not be refundable under any circumstances, as the stay cannot be remarketed.

When we confirm your cancellation in writing we will provide you with details of what (if anything) is owing to you and any deductions we have made.

We strongly recommend that you take out holiday insurance and health insurance at the time of making the booking with cancellation cover. Whilst we allow you to cancel your stay, we cannot guarantee that we will be able to refund any part of the payments you have already made.

If you are unable to travel to CDSHWAV for any reason, or do not arrive on the day of check-in without notifying us, this will be treated as a cancellation.

 

REFUNDS

Cancellations made within 7 working days of your stay date, will not be refundable under any circumstances, as the stay cannot be remarketed.

If your dates are resold:

You will be entitled to a refund of all payments you have made to us minus:

(a) any reduction in the value per night of the new booking received compared with the rate charged to you for your stay nights;

and

(b) a 50 eur cancellation admin charge.

 

If your dates cannot be resold then:

- If you cancelled:

Eight weeks or more prior to the check-in date: We will retain the deposit you paid at the time of booking.

Less than eight weeks to the check-in date: We will retain all payments made and you will be liable for any outstanding balance payment.

If you are unable to travel due to personal illness (e.g. Coronavirus or other sickness), our cancellation policy will apply.

 

- If we cancelled your stay:

In the unlikely event that we need to cancel your holiday, we shall inform you as soon as possible and refund all monies paid to us, by you within 14 days.

If Government policies restrict travel and you are unable to travel to stay with us, you will have the option to postpone your stay to a later date (subject to any differences in price applicable for the new dates) or receive a full refund.

 

GUEST BEHAVIOUR & NOISE

It’s important to us that all our guests enjoy a peaceful and relaxing stay with us. The apartments of CDSHWAV are in quiet locations with other guests and residents nearby. Whilst we are close to party areas, we are not in one of these and we must ask our guests to respect quiet times (23:00-09:00). Loud music in the apartments is not allowed and even less so outside on the terrace (in the El Faro apartment), please use headphones if you must listen to it.

In exceptional circumstances, we reserve the right to ask your party to leave if there is repeated noise after having received two warnings. As you will have breached the terms of your contract with us, no refunds will be forthcoming.

Smoking, vaping and e-cigarettes are not permitted inside the apartments at any time. Please extinguish cigarette butts fully and dispose of them responsibly.

Drugs or prohibited substances are not permitted in the apartments, at any time.

 

COMMERCIAL USE OF THE PROPERTY

The apartments are rented to you for purely non-commercial leisure purposes only. Filming, photography or other commercial uses including influencers/blogger content creation must be done with prior authorization from CDSHWAV management. Additional charges may apply for commercial use.

 

PARTIES & EVENTS

Parties or events are not permitted. The maximum number of persons using the accommodation at any time must not exceed the maximum mentioned on the respective property pages and only those listed on the booking can occupy the property. We reserve the right to terminate the booking without notice and without refund in case of a breach of this condition.

 

CLEANING, DAMAGE & BREAKAGES

A 200 eur refundable damage deposit must be paid when you book with us for the first time. This must be paid a week before your arrival date and will be refunded within a week after your departure, provided that the apartment is left in good condition.

Please leave your accommodation tidy and let us know if anything gets broken so we can replace it for our next guest. Accidents happen and we will only charge for replacements in exceptional circumstances, as we expect a fair degree of wear and tear. If the damage is directly attributable to the guest, then we reserve the right to retain from your deposit to cover damages incurred directly during your stay.

All cleaning, under normal circumstances is covered by our low flat rate (40 eur). This will be added to your final price. If significant additional cleaning is required, including washing up, additional cleaning of the interior or fixtures and fittings then CDSHWAV reserves the right to charge for this work at a rate of 15 eur per hour. CDSHWAV will inform guests if this is needed following their stay and we are aware that it will only be necessary in exceptional circumstances.

Guests will be charged for any item(s) that are removed or lost from the accommodation.

 

DRONES

The use of drones for commercial or private use is strictly prohibited.

 

DOGS & PETS

We welcome well-behaved pets at CDSHWAV. Please let us know if you are planning to bring your furry friend. Your first per stays for free. If you bring more than one pet, we will charge 20 eur per stay, this will be added to your total price. A maximum of two pets is all we can allow. 

 

BBQ AREA (EL FARO APARTMENT)

There is a BBQ on the terrace of El Faro apartment for guests to enjoy. Please leave the BBQ grill clean after using it. Not leaving it clean will incur a cleaning charge.

PRIVATE & COMMUNITY SWIMMING POOL USE
If the property includes a swimming pool, the guest is responsible for the use of the swimming pool. Children should not remain in the pool area without adult supervision. In the case of communal swimming pools the opening hours and guidelines need to be respected. It is not allowed to enter the pool outside the opening hours or without lifeguard supervision as applicable. In some urbanisations pools are closed during off peak season. CDSHWAV are not responsible if the pool is closed or if other maintenance work is being carried out during the duration of your stay. CDSHWAV can’t guarantee or take responsibility for temperatures in the swimming pool. Only plastic glasses, cutlery or plates should be used around the pool to avoid glass falling into the pool that might cause injuries to our guests. Please note that the pool will need to be emptied when glass parts fall into the water. Guests that have caused this will be charged any associated costs. CDSHWAV is not liable for any accidents that may occur through use of swimming pools. In some urbanizations pools are closed during the off-peak season.

 

SERVICE UTILITIES

Should there be a failure in a utility service (e.g. water, electricity, internet) please notify CDSHWAV management immediately and we will aim to restore the service as quickly as possible.

 

RECYCLING & THE ENVIRONMENT

We are providing recycling bins for recyclable waste and ask that you recycle as much as possible and take your waste to the municipal bins which are near the property. This will help reduce your stay’s impact on the environment.

 

PERSONAL PROPERTY

Costa del Sol Home with a View will not be held responsible for any loss or damage to any property on CDSHWAV’s premises. It is recommended that your holiday insurance covers loss or damage to personal effects.

 

CARS & PARKING

EL Faro apartment is part of a community of communal gated parking; it also has an outside community parking, against the western side of the community. You may park a vehicle inside the gated car park. If you wish to bring a second vehicle, this must be parked in the outside car park. If you arrive in a larger vehicle (van or campervan), this must be parked in the outside car park as otherwise it will make it difficult for the cars parked inside to maneuver.

All the roads around both the El Faro Apartment and Esmeralda Studio have free parking, apart from where yellow lines can be seen on the road.

 

EXTREME WEATHER

CDSHWAV is in an area of reliable good weather all through the year. However, occasional bad weather may occur either in the Malaga region or in the areas guests may be travelling from. CDSHWAV holds no responsibility for guests who are unable to attend the accommodation due to extreme weather or traffic conditions (e.g. snow, flooding, high winds, road traffic accidents/congestion, flight delays, etc.). If a guest is unable to reach CDSHWAV due to adverse weather conditions or travel issues, you will lose your full payment and an alternative date will not be offered. Please ensure you have full holiday / travel insurance to cover such eventualities.

In the unlikely case that we make the decision to cancel your stay for safety reasons due to extreme weather (storm or high winds), we will offer you an alternative date, subject to availability.

 

FORCE MAJEURE

CDSHWAV accept no liability for events prior to or during your stay totally beyond our control, e.g. destruction of property due to flood, fire, earthquakes or acts of nature; or if the property becomes uninhabitable due to irreparable damage or on Health & Safety grounds that could not reasonably have been foreseen. In such instances, refunds will be at the discretion of CDSHWAV's management.

 

COSTA DEL SOL HOME WITH A VIEW RESERVES THE RIGHT TO CHANGE OR AMEND THESE TERMS AND CONDITIONS AT ANY TIME.
